As required under HIPAA, this notice describes how medical information about you may be used and disclosed and how you can get access to this information. 

Your privacy matters to us. This notice explains how Webster Direct Primary Care may use and share your health information, your choices and rights, and our responsibilities.

How we may use or share your information

We may use or share your health information when permitted or required by law, including:

For your care. We may use your information to treat you and coordinate care with other healthcare professionals. For example, we may share relevant information with a specialist involved in your treatment.

To operate the Practice and process payment. We may use your information to maintain your medical record, improve care, manage the Practice, collect membership fees, and process other permitted payments.

For health, safety, and legal purposes. We may share information when permitted or required for public health reporting, suspected abuse or neglect, health oversight, workers’ compensation, court or law-enforcement matters, or to help prevent a serious threat to health or safety.

We may also share relevant information with family members, friends, or others involved in your care when you agree, do not object, or when otherwise permitted by law.

For uses or disclosures requiring your written authorization, we will ask you first. This includes most uses of psychotherapy notes, certain marketing activities, and the sale of protected health information. You may revoke an authorization in writing, except for information already disclosed in reliance on it.

We do not sell your health information.

Some records receive additional protection under federal or Indiana law, including certain mental health, communicable disease, genetic, and substance use disorder information. If we create or maintain substance use disorder records protected by federal Part 2 rules, we will follow the additional protections that apply to those records.

Your privacy rights

You may:

• See or obtain a copy of your medical record, including an electronic copy when available.

• Ask us to correct information you believe is inaccurate or incomplete.

• Ask us to contact you in a particular way or at a particular location.

• Ask us to limit certain uses or disclosures. We are not always required to agree. If you pay in full out of pocket for a service, you may ask us not to disclose information about that service to your health plan for payment or healthcare operations when the law requires us to honor that request.

• Request a list of certain disclosures of your health information made during the previous six years.

• Choose someone legally authorized to act for you.

• Receive a paper or electronic copy of this notice at any time.

• File a privacy complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will not retaliate against you for filing a complaint.

Our responsibilities

We are required to protect the privacy and security of your health information, follow the practices described in this notice, and notify you as required by law if a breach may have compromised your information.

We may update this notice as our practices or legal requirements change. The current version will be available in our office, upon request, and at websterdirectcare.com.
